 1) This soft play equipment has been received in good condition and will be returned in the same condition. 

2) Customer agrees to allow Jazzy Soft Play Rentals the right to enter premises of customer’s residence or business location at any given time to repossess soft play equipment, for any reason.

3) In the event, customer fails to pay the agreed rental fees, then the customer agrees to reimburse Jazzy Soft Play Rentals for all outstanding fees, attorney fees, court costs and collection fees. 

4) Customer agrees not to loan, sublet or otherwise dispose of soft play equipment or use it at any other location, for any reason, without written approval by Jazzy Soft Play Rentals.

5) Customer agrees to pay in full the replacement cost, including labor, for all damages to soft play equipment. 

6) If the soft play equipment is lost, stolen, or damaged beyond repair, the renter agrees to pay up to $3,000.00 USD (Three thousand dollars and 0 cents) for replacement costs of the lost, stolen, or damaged equipment.

7) Customer agrees to ensure that all users (and users’ guardians) of the rental review, understand and accept all stated Soft Play rules, and agree to sign an acknowledgement form stating acceptance of the terms and conditions.

8) THERE ARE NO WARRANTIES OF MERCHANTABILITY OR FITNESS EITHER EXPRESSED OR IMPLIED. The person/s or organization renting this Soft Play Equipment from Jazzy Soft Play Rentals will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever and Jazzy Soft Play Rentals cannot be held liable. 

9) Customer acknowledges that use of soft play equipment involves known and unknown risks, including potential physical or emotional injury, paralysis, or death. Customer agrees to release, indemnify, and hold Jazzy Soft Play Rentals harmless from any claims, damages, or liabilities arising from the manufacture, delivery, use, operation, or return of the equipment, including reasonable attorney’s fees. Jazzy Soft Play Rentals is not liable for injuries resulting from misuse, natural events, or circumstances beyond its control. Customer is also responsible for any loss, theft, damage, or destruction of the equipment during the rental period.

Deposit/Reservation 

A refundable, $100 deposit along with a signed contract and acknowledgment / acceptance of the Terms & Conditions, and Soft Play Rental Rules will be required to secure your requested date, time and the location for your rental. This refundable deposit will become NON REFUNDABLE in situations where there is specialized cleaning required and/or damages occur as a result of customer use. The contracted fees are due on the day of delivery, prior to the setting up of the equipment. Failure to pay contracted amount prior to set up will also result in forfeiture of the deposit and cancellation of the contract. 

Cancellations 

Should you need to cancel your reservation, please be sure to call us as soon as possible at 951-512-0622 or email us at: jazzysoftplay@gmail.com. Cancellations 48 hours prior to the event will receive a full refund of your deposit. Cancellations less than 48 hours prior to the event will result in the loss of your $100.00 USD deposit. 

Once Jazzy Soft Play Rentals completes delivery and set-up, there will be NO REFUNDS under any circumstances.

Weather Conditions 

If you are hosting an outdoor event, you assume all weather-related risks. However, in the event of some unforeseen weather-related incidents, Jazzy Soft Play Rentals will work with you on a solution suitable to all parties, at our discretion.  If you cannot hold your party indoors, a refund will be given on your deposit and payment, minus a $4.00 USD transaction fee, unless delivery and set-up have already been completed. In that situation, there will be NO REFUNDS.

Set-Up/Take Down/Delivery 

Set up and Take down are included in your package price. Customer is responsible for clearing all areas needed for the equipment to Set Up and Take Down. Customer is responsible to give a clear passage for Set Up and Take Down. Delivery beyond a 10-mile radius of our Bellflower, CA HQ location is subject to a delivery fee of $5.00 USD per mile. 

Equipment Cleaning and Care 

All our equipment is properly sanitized before the delivery. To reduce the number of germs and therefore the spread of disease or illness, we ask that you immediately disinfect any equipment that has come in contact with the following situations: Leaked soiled diapers, vomit, blood, or mucous. A disinfectant will be provided by Jazzy Soft Play Rentals to ensure proper sterilization that is safe for all, including the equipment. Normal wear is expected. However, if rental equipment is excessively soiled, ripped, torn, damaged, or destroyed upon pickup, Jazzy Soft Play Rentals will charge a minimum $100 Cleaning or Replacement Fee.

Once Jazzy Soft Play Rentals equipment is set up, there will be NO REFUNDS provided under any circumstances.
